Your Privacy Is Important
This privacy policy explains how Tree-Me Charts Pty Ltd ABN 79956300361 ("Tree-Me", "we", "us" and "our") collects, holds, uses and discloses personal information. It applies to the Tree-Me website, Tree-Me account services, Tree-Me APIs, support and billing services, and the Tree-Me Windows app available through the Windows Store.
This policy is intended to be a privacy policy for the purposes of the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
What Is Personal Information?
Personal information is information or an opinion about an identified individual, or an individual who can reasonably be identified from the information or opinion. It may include information about you, your account, your use of Tree-Me, and information you enter or import about other people.
Information We Collect And Hold
Depending on how you use Tree-Me, we may collect and hold:
- account information, including your name, email address, phone number, password hash, email verification status, one-time password verification records, account preferences, referral code, and referral relationship;
- profile information, including profile photos if you choose to upload them;
- subscription and billing records, including Stripe customer identifiers, subscription identifiers, payment status, plan information, and lifetime Premium purchase records;
- support information, including your name, email address, phone number, support ticket subject and message;
- email and notification preferences, including whether you choose to receive hints, product updates or other optional communications;
- website and device information, including IP address, browser, device type, pages visited, session and cookie data, and Google Analytics information;
- Tree-Me app usage and diagnostic information, including login time, uptime, tree count, person count, face count, chart count, style usage, chart link counts, and crash data;
- FamilySearch authorization handoff information, including temporary authorization state, authorization code, and error message values used to connect the Tree-Me app to FamilySearch
Tree-Me Windows App, Family Data And Pictures
The Tree-Me Windows app allows users to enter family information, import pictures, download family history information from FamilySearch where authorized by the user, and create family charts. Information and pictures entered into the app may be stored locally on the user's device.
Users are responsible for ensuring they have the right to collect, enter, import, use, print, export, upload, or share any family information or pictures they use with Tree-Me, including information about living people. Tree-Me assumes that information and pictures entered by a user, and charts printed, exported, or shared by a user, have been lawfully obtained and are appropriate for that user to use and share.
Tree-Me does not control how users use, print, export, or share charts created with the app. Users are responsible for complying with applicable privacy, copyright, and other legal obligations when using or sharing family information or images.
No family information entered, downloaded from FamilySearch or imported is uploaded to Tree-Me web site
FamilySearch
The Tree-Me app can download information directly from FamilySearch when authorized by the user. Tree-Me's website may temporarily receive and store a FamilySearch authorization code and related state information so the app can complete the FamilySearch login process. These temporary authorization handoff records are deleted after use or when they expire.
FamilySearch data downloaded by the app may include family tree information and pictures available through FamilySearch. That information is handled according to the user's FamilySearch authorization and may be stored locally by the Tree-Me app on the user's device.
Tree-Me may support uploading or updating information in FamilySearch in the future. When this functionality is available, users will be responsible for ensuring they have authority to upload or update that information.
How We Collect Information
We collect information directly from you when you create an account, use the website, use the Tree-Me app, contact support, subscribe to Premium, update your profile, change notification preferences, use referral links, or send usage and crash data from the app.
We may also collect information from service providers where needed to provide Tree-Me, such as Stripe billing events, Google Analytics website analytics, CleanTalk antispam checks, Titan SMTP email delivery records, and FamilySearch authorization responses.
Why We Use Information
We collect, hold, use and disclose personal information so that we can:
- provide and maintain Tree-Me accounts, the website, the API, and the Windows app;
- verify accounts, reset passwords, support two-factor authentication, and help keep accounts secure;
- provide Premium subscriptions, billing, purchase records, subscription status, and access control;
- respond to support requests and maintain support history;
- send transactional emails, optional product updates, hints, and other communications you have chosen to receive;
- understand website and app usage, diagnose crashes, improve performance, and improve Tree-Me features;
- support FamilySearch authorization and user-authorized FamilySearch data workflows;
- detect spam, abuse, fraud, and security issues;
- comply with legal obligations and respond to lawful requests; and
- protect our rights, users, systems, and services.
Cookies And Analytics
The website uses cookies and similar technologies for essential functions such as sessions, CSRF protection, authentication, and remembering website state. Some cookies are necessary for the website to work properly.
We also use Google Analytics to understand how visitors use the website. Google Analytics may collect information such as page views, browser and device information, approximate location, and analytics identifiers. You can control cookies through your browser settings, but disabling some cookies may affect website functionality.
Who We Disclose Information To
We do not sell personal information. We may disclose personal information to service providers and other parties where needed to operate Tree-Me, provide requested features, process payments, deliver email, protect the website from spam, measure website use, or comply with law.
- Stripe, for Premium billing, checkout, subscriptions, payment processing, customer records, payment status, and billing webhooks. Tree-Me does not store raw card details;
- Titan Email or our configured SMTP email provider, for transactional emails, account verification, password reset messages, support emails, and optional product or marketing emails;
- Google Analytics, for website analytics and reporting about how visitors use the Tree-Me website;
- CleanTalk, for antispam checks on help and contact form submissions;
- FamilySearch, where the user authorizes the Tree-Me app to download data from FamilySearch or, when future functionality is released, upload or update data in FamilySearch;
- Microsoft and the Windows Store, where relevant to distributing, installing, licensing, updating, or supporting the Tree-Me Windows app;
- hosting, database, storage, security, logging, backup, and technical service providers that help us operate the Tree-Me website, API, account services, support services, and app telemetry services;
- professional advisers, insurers, regulators, law enforcement, courts, or government agencies where required or permitted by law; and
- a new owner or proposed owner if the ownership or control of all or part of our business changes.
Services removed from Tree-Me, such as Facebook social login, Google social login, Zoho OAuth, Mailgun, AWS SES, and Postmark, are not used as current Tree-Me privacy processors.
Overseas Disclosure
Some service providers we use may store or process information outside Australia. Overseas locations may include the United States and other countries where Stripe, Google, CleanTalk, FamilySearch, Microsoft, Titan Email, hosting providers, database providers, storage providers, security providers, or their related companies operate.
Storage, Security And Retention
We hold website, account, support, billing status, referral, notification preference, FamilySearch authorization handoff, and app telemetry records in systems operated by us or our service providers. The Tree-Me Windows app may also store family information, pictures and charts locally on the user's device.
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorized access, modification or disclosure. These steps may include access controls, authentication, password hashing, encrypted two-factor authentication secrets, secure service configurations, and limiting access to people who need the information for their role.
We keep personal information for as long as needed for the purposes described in this policy, including providing Tree-Me, maintaining account and billing records, complying with legal obligations, resolving disputes, and improving or securing our services. We take reasonable steps to delete or de-identify information when we no longer need it.
Marketing And Optional Communications
We may send product updates, hints, offers, tips or similar communications where you have subscribed or have not opted out. You can opt out using unsubscribe links, notification preferences, or by contacting us. We may still send transactional or service-related messages, such as account verification, password reset, billing, support, or security messages.
Access And Correction
You may request access to, or correction of, personal information we hold about you by contacting us. We will respond within a reasonable time. There may be circumstances where we are not required to provide access or correction, or where we need to verify your identity before responding.
Information stored locally in the Tree-Me Windows app is controlled by the user on their device. Tree-Me may not be able to access, correct, recover or delete local app data unless it has been sent to Tree-Me services.
Complaints
If you have a privacy complaint, please contact us using the details below and mark your message for the attention of the Privacy Officer. We will consider your complaint and tell you whether further investigation is required. We will notify you of the outcome of our review.
If you remain unsatisfied with the way we have handled a privacy issue, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au for guidance on alternative courses of action that may be available.
